Terms of Service

Please read these Terms of Service ("Terms") carefully before using ThumbnailGrader ("the Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

ThumbnailGrader provides AI-powered analysis and scoring of YouTube thumbnail images. Users upload thumbnails, and the Service returns scores, feedback, and recommendations designed to help improve click-through rates. The Service is intended for content creators and educators.

2. Accounts

• You must provide a valid email address to create an account.
• You are responsible for maintaining the confidentiality of your password.
• You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to use the Service. By registering, you confirm you meet this requirement.
• You may not create multiple accounts to abuse the free credit system, referral program, or any other promotional feature.

3. Credits

• The Service uses a credit system. Each thumbnail graded costs 1 credit.
• New accounts receive 15 free credits upon registration.
• Additional credits can be earned through the referral program or purchased directly.
• Credits are non-refundable and have no monetary value outside of the Service.
• Credits do not expire while your account is active.
• We reserve the right to adjust credit values, prices, and earning rates with reasonable notice.

4. Referral Program

• You may earn credits by referring new users to the Service using your unique referral link.
• Referral credits are awarded when a new, distinct user signs up using your link.
• Self-referrals — using your own referral code to create additional accounts — are strictly prohibited and will result in account suspension.
• We reserve the right to revoke referral credits and suspend accounts where fraud or abuse is suspected.

5. Subscriptions and Payments

Paid subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on a monthly basis until you cancel. All payments are processed securely through Stripe. See our Cancellation Policy for details on cancellations and refunds.

6. Acceptable Use

You agree not to:

• Upload images that are illegal, obscene, defamatory, or infringe on any third-party intellectual property rights.
• Attempt to reverse-engineer, scrape, or extract the AI models or underlying technology.
• Use automated tools or bots to interact with the Service without our written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Circumvent any technical measures we use to enforce these Terms.

7. Content You Upload

You retain ownership of all thumbnail images you upload. By uploading an image, you grant us a limited, temporary license to process it solely for the purpose of providing the grading service. Images are deleted immediately after processing and are not used to train AI models or shared with third parties.

8. AI-Generated Results

The grades and feedback provided by ThumbnailGrader are generated by an AI model and are for informational and educational purposes only. Results are not guaranteed to improve your YouTube performance. We make no warranties about the accuracy, completeness, or fitness for any particular purpose of the AI-generated analysis.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THUMBNAILGRADER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct we determine to be harmful to the Service or other users. You may delete your account at any time by contacting us.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which ThumbnailGrader operates, without regard to conflict of law principles.
